Story Photobooth's terms and conditions of hire from January 1st 2022

 

These terms and conditions supersede any previous terms and conditions and apply to all new or existing bookings from 01/01/2022. 

On payment of  deposit or balance on any of the services offered by Story Photobooth's it is deemed you have read, fully accept and  agree to be bound by the following terms and conditions.

 

Terms of reference

The person/ persons / individual / company representative booking the hire of Story Photobooth product, its props and accessories 

Us / We / The supplier

The following contract, its terms and conditions constitutes an agreement between Story Photobooths and the Customer for the hire of a Story Photobooth product, its props, accessories or package upgrades. This agreement supersedes any previous agreements whether written or oral, made between the parties.

 Period of service / hire

The supplier agrees to provide for hire, a Photo Booth operational and available for use for a minimum of 80% of the agreed service / hire period. This is to permit any essential or necessary maintenance of the Photo Booth or accessories (including the changing of printer paper rolls etc)

 

Payment

The payment of a £50.00 deposit per hire period constitutes an agreement to hire a Story Photobooth product, and acceptance in full of the terms and agreements associated with the hire. Payment of a deposit confirms the booking of the hire.

The balance of the agreed rental charge is due 21 days before the event. In the event of non-payment, the hire becomes null and void with loss of deposit.

Full details of additional hire period costs are available on our website. If you wish to extend the hire period on the day of the hire in excess of the agreed service period, additional rental charges will be payable by the Customer as per the advertised prices. Payment of all additional rental charges must be made before any additional service period commences.

 

Methods of Payment

Deposit can be made by Debit / Credit card through Paypal, Bank Transfer or Cash. Balance to be paid by bank transfer no later than three weeks prior to the hire date unless alternative method is agreed with us.

Access, space & power requirements

For safety and comfort, a minimum floor area of 3m x 3m is required to accommodate the photobooth and props. The Customer will arrange for an appropriate space to be made available for the Photo Booth at the event venue, and will ensure  mains electricity supply comprising of a single 13amp socket located within the space designated for the Photo Booth.

 

Safe Operating 

The Photobooth is not designed to accommodate more than a maximum of 6 persons safely  for an "open booth" and 4 persons for an enclosed booth. The operator has a right to refuse more than the permitted number of persons visiting the booth at any one time in the interest of safety to the public and the safety and security of the equipment. Any variation to this will be entirely at the discretion of the operator, notwithstanding the "fair use policy" for "unlimited prints" upgrades. Food and drink will strictly not be permitted within the Photobooth operating area. Persistent infringement of this rule or any abuse directed towards Story Photobooth’s operators for enforcing this or any other rule designed to ensure safety of the equipment or guests will result in the booth being closed and the hire terminated without recourse for refund of fees. Any persons deemed under the influence of alcohol or exhibiting disruptive or abusive behaviour will not be permitted in the Photobooth area.

Idle Hours

Set up time and dismantling time is between 60 -90 minutes. This time not counted as part of your hire period time. Sometimes customers request an earlier set up time or prevent us breaking down and removing the equipment directly after the hire period. Idle hours are the times between set up and the required start time / after the finish time of the booth hire. Idle hours are agreed at commencement of the hire and charged at £25 per hour. Sometimes we will agree with the venue to set up and breakdown outside of these times. If we decide to set up earlier than 60 mins prior to the event or break down and remove equipment at a later time due to our own operational or logistical reasons as agreed with the venue, the booker / customer will not be charged additional idle time outside the hire period agreed price. 

 

Unlimited Prints Fair Use Policy

When purchasing the "unlimited prints" option, the customer agrees to be bound by the Unlimited Prints Fair Use Policy. To prevent abuse of this option, prints will be limited to a maximum of 8 per visit to the booth (up to 7 for guests and one for the album). The Photobooth is not designed to accommodate more than a maximum of 6 persons safely  for an "open booth" and 4 persons for an enclosed booth.

Loss or damage to equipment

The Customer assumes complete responsibility for any loss of or damage to the Story Photobooth’s equipment (other than fair wear and tear) caused by any misuse of the equipment by the customer, their employees or their guests.
The customer shall be responsible for any loss of or damage to the Story photobooth’s’ equipment caused by Theft, Fire, Flood or Accidental Damage.

Indemnification

 

Public Liability and PAT 

Story Photobooth’s are insured for Public Liability will supply evidence of cover for current Public Liability Insurance and evidence of small appliance testing (PAT) to the customer and venue on request.

The Customer agrees to following:
a) The Customer will indemnify Story photobooths against any and all liability related to the Customer’s Event and use of the Story photobooth’s’ equipment.
b) The Customer will indemnify the Story photobooths against any and all liability associated with the use of any images taken at the Customer’s event by the Story photobooths or by its operatives

The Customer agrees to and understands the following: All persons using the Photo Booth at the Customer’s Event hereby give Story Photobooths the right and permission to copyright and to reproduce or otherwise use any photographic portraits or pictures of any Photo Booth user who may be included in whole or in part, via any or all media now or hereafter known for illustration, art, promotion, advertising, trade, or for any other purpose. In addition the customer hereby releases, discharges and agrees to maintain Story photobooth free from any liability arising out of the capturing of images or any subsequent processing or publication thereof including, without limitation, any claims for libel or invasion of privacy. If any provision of these terms shall be unlawful, void, or for any reason unenforceable under contract law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof.

This is the entire agreement between the Provider and the Customer relating to the subject matter herein and shall not be modified except as agreed in writing by both parties.

In the unlikely event that it is not possible, other than for reasons beyond the Story photobooths control, to provide an operational Photo Booth for at least 80% of the agreed service period, we will provide a refund equivalent to but not exceeding the contracted hire price. If the reason for non-service provision is beyond Story Photobooth’s control on the day of the hire and attributed to events entirely beyond Story photobooth’s control on the day of the hire, Story photobooth will not be liable to provide a refund of the hire.  If the rental includes a photographic printer, and printed photographs cannot be provided on site at the time of the event for any reason including force majeure, mechanical breakdown or damage to printer or media, Story photobooths will provide printed copies as per the original package agreement at the earliest opportunity after the event. 

In the very unlikely event that no service is received for whatever reason, Story photobooth’s’ maximum liability will be the return of all payments received from the Customer. This payment will be made no later than 21 days from the date of the event. Story photobooths are not responsible for any consequential damages or lost opportunities upon breach of this agreement.
